3/ Content and Use of Information

The trademarks “GLOBE DIFFUSION”, “GLOBE EXPERTS”, “GLOBE INSTORE”, and “GLOBE effective shopper experience” are registered trademarks.

All content, pages, scripts, graphics, photographs, and icons of the Site and/or GLOBE GROUPE social media pages are the exclusive property of Hawker or third parties who have authorized Hawker to use them. All rights of reproduction or representation are strictly reserved.

Consequently, any reproduction, representation, use, adaptation, modification, incorporation, translation, commercialization, partial or complete, of the Site and/or GLOBE GROUPE social media pages or their elements, by any means and on any medium whatsoever (paper, digital, etc.) are prohibited without the prior written authorization of Hawker, under penalty of constituting an infringement of copyright and/or design and model rights and/or trademark rights.

Logos, trademarks, and iconographies related to other companies and products cited on the Site and/or on GLOBE GROUPE social media pages are the respective property of their authors and/or holders.

4/ Personal Data

When browsing the Site, users are required to provide personal data.

The Site complies with French and European standards regarding privacy and personal data protection, particularly Law No. 78-17 of January 6, 1978, on information technology, files, and freedoms, as amended by Law 2004-801 of August 6, 2004, and European Regulation 2016/679 on the protection of natural persons with regard to the processing of personal data and the free movement of such data.

4.1- Data Controller
The data controller of personal data is Hawker.

4.2- Nature of Collected Data
The data collected on the Site enables Hawker to identify users directly or indirectly.

This may include nominative data such as name, first name, postal address, email address, phone number, date of birth, and gender.

4.3- Purpose of Collection
The personal data collected on the Site is used for the following purposes:

  • Registration and authentication of users applying online for a job via the contact form;
  • Contacting users by Hawker;
  • Managing online applications;
  • Conducting technical operations related to selecting users who have applied online for potential recruitment and/or the establishment of a work contract;
  • Managing the Site, user operations, application requests, user rights requests (right of access, rectification, erasure, opposition, limitation, and portability), and disputes related to the use of the Site;
  • Improving the quality of the Site.

Additionally, Hawker may use the data to fulfill legal and/or regulatory obligations.

4.4- Time of Collection
The data collected by Hawker is freely provided by the user.

Personal data is collected when using the Site, when the user sends an application request to Hawker, or applies online via the contact form.

4.5- Consent
The legal notices are systematically brought to the attention of users when they submit an application or apply online. Indeed, submitting an application and applying online implies the express, full, and complete acceptance by the user of the legal notices.

By ticking the box: “I have read and accept the legal notices” when submitting an application and/or applying online, the user consents to their personal data being stored and processed by HAWKER and/or its partners.

Users who provide the personal data of a third party must confirm that they have obtained the third party’s consent regarding the processing, publication, and/or dissemination on the Site of the third party’s personal data.

If the user wishes to withdraw their consent to the processing of their data, they simply need to send a request to the following address: contact@globe-groupe.com.

4.6- Recipients of Personal Data
Personal data collected on the Site is primarily intended for Hawker and is not disclosed to third parties for commercial purposes.

Other recipients may have access to the personal data. This includes, in particular, companies that Hawker directly or indirectly controls within the meaning of Article L. 233-3 of the French Commercial Code, its service providers or subcontractors, its clients, etc. The list of recipients can be consulted at any time upon request from users.

Additionally, Hawker may be required to transmit the collected data to a third party upon receiving a request from a judicial or administrative authority authorized by law, requesting the communication of this information in accordance with current legislative provisions. Where required by law, the user’s consent will be obtained, or an opt-out option will be provided before any data transmission.

Finally, in the event of a change in Hawker’s control, acquisition, collective procedure, or sale of assets, the data collected by Hawker may be transferred to third parties.

4.7- Data Retention Period
Personal data of users is retained for the duration of the user’s mission if they are selected after applying and for a period of two (2) years from the end of their mission. For users not selected, their data is retained for a period of two (2) years from their application.

Notwithstanding the above, data that Hawker needs to retain as evidence, for legal, administrative, or regulatory purposes, may be retained for a longer period.

4.8- Users’ Rights
In accordance with Law No. 78-17 of January 6, 1978, as amended by Law 2004-801 of August 6, 2004, and European Regulation 2016/679 on the protection of individuals with regard to the processing of personal data, users have:

  • The right to access their personal data;
  • The right to rectify their personal data;
  • The right to erase their personal data;
  • The right to object to the use of their personal data;
  • The right to limit the use of their personal data;
  • The right to data portability;
  • The right to file a complaint with the CNIL.

When exercising any of these rights, users must provide Hawker with the necessary identification elements: name, first name, email, and possibly their postal address. Furthermore, in accordance with the current regulations, the request must be signed, accompanied by a photocopy of an identity document bearing their signature, specify in detail the right they wish to exercise, and the address to which they wish to receive the response.

Hawker commits to responding within a maximum of one (1) month from the receipt of the user’s complete request.

Due to the complexity of the request and/or the number of requests, this period may be extended to two (2) months, provided that Hawker informs the user within one (1) month of the receipt of their request of the reasons for the delay.

If Hawker does not respond to the user’s request, Hawker will inform the user no later than one (1) month from the receipt of the request of the reasons for its inaction.

5/ Hypertext Links

On the Site, the user may have access to various links directing them to third-party websites.

Hawker will not be held responsible for the content of websites referenced on the Site and/or on GLOBE GROUPE’s social media pages, nor for the information or content provided by third parties, or the privacy policies of those third parties accessed by the user of the Site.

Hawker exercises no control over hypertext links and/or other promotional formats.

Consequently, Hawker provides no guarantee, particularly regarding:

  • The accuracy, quality, completeness, or exhaustiveness of the content of indexed websites;
  • Accessibility and functionality issues of indexed websites.

Hawker can in no way be held responsible for any dispute arising between a user and an indexed website on the Site and/or on GLOBE GROUPE’s social media pages, particularly regarding any losses or damages suffered, as the operators of the indexed websites are solely responsible for the content of their websites.

 

6/ Cookies

When browsing the Site, cookies or other navigation data collection methods are used by the Site or by third-party service providers for the Site and are placed on the user’s device (computer, mobile, or tablet).

The cookies used by Hawker allow the identification of users, recognition of their browser when they connect to the Site, the recording of their preferences, and adaptation of the Site’s presentation to the display preferences of the user’s device.

The storage of a cookie is subject to the user’s consent. Therefore, users have the option to configure their browser software to oppose, either completely or partially (depending on the issuer), the storage of “cookies.” The configuration also provides the option to accept or reject cookies on a case-by-case basis before they are stored on the user’s device.

Thus, users who wish to prevent the storage of cookies can follow the specific procedure for each browser, as described in the help menu of their browser.

These procedures are as follows:

For Mozilla Firefox:
The user must go to the “tools” menu, then the “options” tab. They must then click on the “privacy” icon / “show cookies” and select the options that suit them.

For Microsoft Internet Explorer 6.0 and later:
The user must choose the “tools” menu, then “Internet options,” click on the “privacy” tab, and then select the desired level.

For Microsoft Internet Explorer 5:
The user must choose the “tools” menu, then “Internet options,” click on the “security” tab, select “Internet,” then “customize level.” Finally, under the “cookies” section, they must choose the options that suit them.

For Google Chrome:
The user must choose the “tools” menu, select the “options” section, click on the “advanced options” tab, and access the “privacy” section. Finally, under “show cookies,” they must choose the options that suit them.

For Safari:
The user must go to the Safari menu and choose the “preferences” menu, then click on “security” and select the options that suit them.

 

7/ Site Interruption

Hawker reserves the right to interrupt the operation and/or access to the Site at any time, with or without notice, particularly to ensure corrective and evolving maintenance or to modify the content or presentation of the Site. Whenever possible, Hawker will inform users in advance of any corrective or evolving maintenance operations. Furthermore, users acknowledge that the Site may be interrupted for reasons beyond Hawker’s control, and as such, Hawker cannot guarantee continuous access to the Site.

In any case, Hawker cannot be held responsible for any interruption and/or malfunction of the Site, regardless of the cause.

 

8/ Warranties – Liability

Users understand and accept that the Site is made available to them “as is” without any warranty, express or implied, regarding any or all parts of the Site.

Hawker strives to ensure that the information accessible via the Site is accurate and up to date. However, no guarantee is given in this regard.

In no case shall Hawker be held liable for any direct or indirect damage, regardless of its cause, origin, nature, or consequences, arising from the consultation or use of the Site.

 

9/ Modifications to the Legal Notices

Hawker reserves the right to modify these legal notices at any time, particularly to take into account any legal, jurisprudential, editorial, functional, and/or technical developments. The version that prevails is the one accessible online at the time of the application or submission. Any consultation of the Site after the publication of modified legal notices constitutes acceptance without reservation by the user of the new legal notices.
